TMT143MUSIC does not guarantee commercial success, chart or streaming performance, publishing deals, radio play, or personal taste satisfaction beyond agreed revisions. Each song is an artistic interpretation based on your submitted story and style preferences.
3. Payment Terms
Full payment is required before work begins unless otherwise agreed in writing. Accepted methods include PayPal, credit/debit card through PayPal checkout, or other approved payment providers. Prices are subject to change without notice.
4. Refund Policy
All sales are final. Refunds will not be issued once writing has begun, concepts have been delivered, demos have been created, artwork has been produced, or digital files have been sent.
If a project has not yet started, TMT143MUSIC may, at its sole discretion, offer a partial or full refund. Chargebacks filed after delivery may result in revocation of usage rights, cancellation of licensing permissions, and legal collection efforts where permitted by law.
5. Revisions
Packages may include limited revisions for factual corrections, small lyric adjustments, or reasonable creative refinements. Major rewrites, concept changes, or complete direction changes may require additional fees. TMT143MUSIC determines whether a change qualifies as a revision or a new project scope.
6. Delivery Timeline
Estimated turnaround times are approximate and not guaranteed. Delivery may vary due to workload, project complexity, revisions, holidays, or customer response delays. TMT143MUSIC is not liable for delays outside of reasonable control.
7. Ownership & Copyright
Unless otherwise agreed in writing, TMT143MUSIC retains all original copyrights, publishing rights, and intellectual property rights to all lyrics, melodies, demos, recordings, artwork, and creative materials. Purchasing a custom song does not transfer copyright ownership. Customers receive a limited personal-use license only.
8. Personal Use License
Standard purchases include a non-transferable personal-use license for gifts, family sharing, personal listening, memorials, weddings, anniversaries, birthdays, or private events.
Without written approval, customers may not commercially release, monetize, distribute, claim authorship, register copyrights, sell, sync to film/TV, pitch to publishers, or exploit the work commercially in any form.
9. Commercial Licensing
Commercial use — including Spotify/Apple Music releases, monetized YouTube, film/TV sync, advertising, label pitching, or public distribution — requires a separate written licensing agreement and additional fees. Licensing availability is determined solely by TMT143MUSIC.
10. Demo Recordings
Demo recordings are provided for reference and personal listening unless otherwise licensed. Demos may include session singers, AI-assisted production tools, or digital instruments. Commercial recording rights are not granted unless explicitly stated in writing.
11. Customer Responsibilities
You agree that all submitted information is accurate, you have permission to share any names, stories, or personal details included in your order, and submitted materials do not violate any third-party rights.
12. Right to Refuse Service
TMT143MUSIC reserves the right to refuse or cancel any order for any reason including abusive behavior, hate speech, illegal content, harassment, impersonation, or copyright infringement concerns.
13. Promotional Use
Unless requested otherwise in writing before project completion, TMT143MUSIC may display portions of lyrics, song titles, artwork, or excerpts for portfolio, social media, or marketing purposes. Sensitive requests may be excluded upon written request.
14. AI-Assisted Production Disclosure
Certain production elements may involve AI-assisted tools for demo production, instrumental generation, vocal processing, artwork, or video. All final creative direction, lyric writing, and project approval remain under human supervision by TMT143MUSIC.
15. Limitation of Liability
To the maximum extent permitted by law, TMT143MUSIC is not liable for indirect damages, emotional distress, lost profits, streaming outcomes, or consequential damages. Total liability shall never exceed the amount paid for the specific order.
16. No Guarantees
TMT143MUSIC makes no guarantees regarding viral success, industry placement, publishing opportunities, audience growth, monetization, or music industry outcomes. Music and entertainment are inherently subjective and unpredictable.
17. Digital Delivery
Most products are delivered digitally through downloadable links, email, website access, cloud delivery, or streaming preview links. Customers are responsible for downloading and saving their files after delivery.
18. Governing Law
These Terms are governed by the laws of the State of Michigan, United States. Disputes shall be handled exclusively within appropriate courts in Michigan.
19. Changes to Terms
TMT143MUSIC reserves the right to update these Terms at any time without prior notice. Updated versions become effective immediately upon publication.
